A. Revocation Instruction
Introduction
Consumers have a right of withdrawal in accordance with the following provisions, whereby consumers are any natural persons who conclude a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity:
Right of Withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason.
The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods or has taken possession of them.
To exercise your right of withdrawal, you must inform us (THE KERSY COMPANY GmbH & Co. KG, Lindenallee 21, 63619 Bad Orb, Germany, Tel .: 060529180030, Email: info@kersystrauss.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Withdrawal
If you withdraw from this contract, we must reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract. We will use the same means of payment for this repayment as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. Returns can only be sent to the following address: Kersy Strauss c/o Kumko GmbH, Otto-Hahn-Straße 49, 63456 Hanau, Germany.
The deadline is met if you send the goods before the period of fourteen days has expired.
We will bear the cost of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to examine their nature, properties and functioning.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
General Notes
1) Please avoid damaging and contaminating the goods. Please return the goods to us in their original packaging with all accessories and with all packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us carriage forward.
3) Please note that the above points 1-2 are not a prerequisite for effectively exercising the right of withdrawal.
